The short answer: there is no federal gambling age, so the legal gambling age by state depends on the product. Casinos and sportsbooks are 21 in most states, lottery tickets are 18 in most states, and every legal US online casino requires 21.
The 18s are the exceptions. Sports betting is 18 in Montana, New Hampshire, Rhode Island, Wyoming and DC. Casinos are 18 in Rhode Island and Montana and at many tribal casinos in Oklahoma, Idaho, Minnesota, Washington and parts of California. The lottery is 21 in Arizona, Iowa, Louisiana and Mississippi and 19 in Nebraska.
If you run an age gate, sign off on a campaign or build a state page, “how old do you have to be to gamble?” is four questions: the age for a casino floor, a sportsbook, a lottery ticket and an online casino. Each state answers them separately. Many of the tables ranking for this search give one number per state, and some still show Rhode Island casinos at 21, Mississippi with no lottery or Wyoming online betting at 21. This hub gives the minimum age for all 50 states and DC across those four products and flags the cells we could not confirm against a primary source.
Legal gambling age by state: the 50-state table (October 2026)
How to read the table:
- Casino: the minimum age to play slots and table games at a land-based casino, commercial or tribal. “Tribal” means the state’s only casinos are on tribal land, where each tribe can set an age above the legal floor.
- Sports betting: the minimum age to place a bet with a licensed sportsbook, retail or mobile. “Not legal” means the state has no legal sportsbook at any age.
- Lottery: the minimum age to buy a state lottery ticket, including scratch-offs.
- Online casino: real-money online slots and table games licensed by the state. Only seven states have them live.
- * marks a cell that matches our state guides and our US gambling laws by state hub, but where we could not open the regulator’s or lottery’s own age statement on October 11, 2026. Check it before you hard-code it.

Why most states use 21, and where 18 comes from
No federal law sets a gambling age. Each state writes its own, usually separately for each product it licenses, so the same 19-year-old can legally buy a scratch-off and be turned away from a slot machine in the same building.

Three patterns explain almost every cell in the table:
- Commercial casinos and sportsbooks are 21 almost everywhere. States that licensed casinos and, after 2018, sports betting tended to match the gaming age to the drinking age, which makes the floor easier to police. Michigan is typical: its casino law says a person under 21 “is not permitted to make a wager” (MCL 432.209). Nevada’s equivalent is NRS 463.350.
- Tribal casinos can go lower. Under the Indian Gaming Regulatory Act, a tribe’s gaming runs under its compact with the state. Where the compact sets 18 as the floor, each tribe decides whether to raise it. That is why Oklahoma has 18+ and 21+ casinos a few miles apart. Arizona went the other way: its law has required every compact signed or renewed since June 1, 2003 to bar wagering under 21, as our Arizona gambling law guide explains.
- Lotteries mostly use 18. The exceptions are deliberate: Iowa law says a ticket “shall not be sold to a person who has not reached the age of twenty-one” (Iowa Code 99G.30), and Louisiana and Mississippi also set 21.
What states can you gamble in at 18?
You can legally gamble at 18 in most states if the product is the lottery. For casinos and sports betting the list is much shorter, and in most cases the 18 is set by a tribe or a single venue rather than by state law.
Can you legally bet on sports at 18?
Yes, in five jurisdictions where state law sets 18 for sports betting:
| Jurisdiction | Sports betting age | What sets it |
|---|---|---|
| Rhode Island | 18 | R.I. Gen. Laws § 42-61.2-3.3 requires standards “prohibiting persons under eighteen (18) years of age from participating in sports wagering” |
| Wyoming | 18 | W.S. 9-24-105: “No person under the age of eighteen (18) years shall engage in online sports wagering” |
| District of Columbia | 18 | The DC Office of Lottery and Gaming sets 18 to place or cash a sports wager; several private sportsbooks in DC use 21 as house policy |
| New Hampshire | 18* | RSA 287-I, the sports wagering law run through the New Hampshire Lottery |
| Montana | 18* | Sports betting runs through the Montana Lottery in licensed venues; Montana’s general gambling statute (MCA 23-5-158) also sets 18 |
Some tribal sportsbooks in Washington also accept 18-year-olds, because each tribe follows its own casino age. Everywhere else with legal sports betting, the minimum is 21.
Kentucky is no longer on that list. The legislature overrode Gov. Andy Beshear’s veto of HB 904 in April 2026, raising the sports betting age from 18 to 21 (Legal Sports Report). The change took effect on July 15, 2026, and left the horse racing age at 18. Some age tables and AI answers still list Kentucky as an 18 state. Our Kentucky gambling law guide covers the rest of HB 904.
Where you can gamble at a casino at 18
| State | What is open at 18 | What sets it |
|---|---|---|
| Rhode Island | Land-based casinos (Bally’s Twin River Lincoln states “Must be 18+” on its own site); online casino is 21 | Casino rules for the land-based floors; R.I. Gen. Laws § 42-61.2-3.4 sets 21 for iGaming |
| Montana | Licensed gambling venues, including video gaming machines and card rooms | MCA 23-5-158 bars anyone under 18 from gambling activity |
| Oklahoma | WinStar, Choctaw, Osage and other tribal casinos; Cherokee casinos and River Spirit are 21 | Compact floor of 18 plus each tribe’s house rules |
| Idaho, Minnesota | Many tribal casinos | Tribal policy under the compacts |
| Washington | Many tribal casinos and licensed cardrooms | RCW 9.46.228 sets 18 for authorized gambling; tribes can set 21 |
| California | Some tribal casinos, usually those without alcohol on the gaming floor; cardrooms are 21 | Each casino’s policy |
| Michigan, New York, South Dakota | Some tribal casinos, such as Turning Stone in New York; commercial casinos are 21 | Tribal policy |
| Florida | Live poker; slots and table games are 21 | Venue policy |
| Texas | Speaking Rock in El Paso; other tribal venues are mostly 21 | Tribal policy |
Two mistakes show up often in age tables. Michigan is not an 18 state: Detroit’s commercial casinos and every licensed sportsbook and online casino require 21, and only some tribal casinos admit 18-year-olds. And Kansas, Maine, Vermont, North Carolina and South Carolina are 18 only for the lottery. Kansas, Maine and North Carolina set 21 for casinos and sports betting, Vermont has no casinos and sets 21 for sports betting, and South Carolina has neither.
How old do you have to be to gamble in a casino?
You have to be 21 to gamble at a casino in most states, including every commercial casino state except Rhode Island and Montana. Nevada, New Jersey, Pennsylvania, Mississippi, Louisiana and the other commercial markets all set 21. At tribal casinos the age can be 18 or 21, and it can differ between casinos in the same state.
Being under 21 usually does not mean you cannot enter the building. Most states bar under-21s from gaming areas, not from hotels, restaurants or shows. Michigan’s law, for example, keeps anyone under 21 out of the area of a casino “where gaming is being conducted”, with an exception for employees aged 18 or older. Nevada goes further and treats an under-21 who stops to watch a game as loitering. For a property, that makes the age rule a floor plan question as well as an ID check.
How old do you have to be to buy lottery scratchers?
You have to be 18 to buy lottery tickets, scratch-offs included, in most states. The exceptions are:

- 21: Arizona, Iowa, Louisiana and Mississippi. Louisiana law makes it “unlawful for any person under twenty-one years of age to purchase a lottery ticket” (R.S. 47:9070), and the Mississippi Lottery says you “must be 21 years of age or older to play” its games.
- 19: Nebraska*.
- No lottery at all: Alabama, Alaska, Hawaii, Nevada and Utah.
Lottery-run machines can carry a higher age than paper tickets. South Dakota’s lottery sets 18 for scratch and lotto games and 21 for video lottery, and Oregon also uses 21 for video lottery. Delaware shows how one regulator can run two ages: its lottery says you must be 18 to buy tickets and 21 for video lottery, sports, table games and internet games.
“Most states sell lottery tickets at 18” is true, but it misses four states at 21 and Nebraska at 19, which is where most underage-sale problems at multi-state retailers come from.
Do the ages differ for poker, horse racing and bingo?
Often, yes. Pari-mutuel racing, bingo and charitable games sit under separate laws from casinos, and many states set them at 18 even where the casino age is 21. Examples from the table above:
- Horse racing: Kentucky kept 18 for pari-mutuel wagering when HB 904 raised its sports betting age to 21.
- Poker: Florida card rooms admit 18-year-olds to live poker while slots and table games are 21, and Washington’s licensed cardrooms are 18.
- Bingo and pull-tabs: Alaska sets 19 for bingo and 21 for pull-tabs, even though it has no casinos or lottery.
If your product mixes verticals, such as a racebook inside a sportsbook app, map the age to each product, not to the app.
What is the legal age for online gambling?
It is 21 in every state with a legal online casino: Connecticut, Delaware, Michigan, New Jersey, Pennsylvania, Rhode Island and West Virginia. Rhode Island shows why this matters: its law sets 18 for sports betting but requires online casino rules to bar anyone who has “not reached twenty-one (21) years of age.” Maine has legalized online casinos, but its regulator now points to a launch in early 2027.
Online sports betting follows the state’s sports betting age, so it is 18 in Wyoming, New Hampshire, Rhode Island and DC (Montana has no statewide mobile app) and 21 elsewhere. Online lottery sales, where they exist, follow the lottery age.
Products that run outside state gambling licences set their own ages:
- Daily fantasy sports: usually 18 under operator terms, but some states set a higher age by law. Virginia’s HB 145, signed in April 2026, moves fantasy contests under the Virginia Lottery and requires operators to verify players are at least 21, while New York and Ohio license DFS at 18.
- Prediction markets: Kalshi and similar CFTC-regulated exchanges accept users from 18. States that want to treat sports event contracts as wagering, and apply a 21 age, are fighting them in court, as our explainer on how prediction markets and event contracts work sets out.
- Sweepstakes casinos: each brand sets 18 or 21 in its terms, where the state still allows them. Our sweepstakes casino legal map tracks which states have banned them.
- Offshore sites: they have no licence in any US state, so there is no legal age to meet. Our guide to whether offshore sports betting is legal covers the risk.
Does the age follow where you live or where you are?
Where you are. The age that applies is the one in the state where the bet is placed, not the bettor’s home state. That is why licensed apps geolocate every wager: an 18-year-old can bet legally in Wyoming, but the same account is blocked from the sportsbook after crossing into Colorado, where the age is 21. Land-based venues work the same way, with the rules of the state where the property sits.
Is DraftKings 21 or 18?
For the sportsbook and online casino, DraftKings, FanDuel and other licensed brands follow the state’s legal age, which is 21 almost everywhere they operate. Their fantasy and prediction products are different: in states where DFS is legal at 18, such as Ohio and New York, the same brands accept fantasy players from 18. For affiliates, that means one brand can carry two age rules, and your copy needs to match the product you promote, not the logo.
How the gambling age is enforced
States put the legal risk on the business, not mainly on the underage player. Nevada’s NRS 463.350 makes it a misdemeanor for the licensee and its staff to let someone under 21 gamble, and a mistaken belief about age is no defense. Caesars Entertainment agreed to pay a $100,000 fine in Nevada in 2012 after employees let underage patrons gamble and drink (Las Vegas Sun). Virginia makes accepting a sports bet from anyone under 21 a Class 1 misdemeanor for the permit holder, and North Carolina makes it a misdemeanor for someone under 21 to place a wager.
Online, the check moves to account opening. Licensed sportsbooks and online casinos verify identity and date of birth before the first deposit, and must also confirm the bettor is physically inside the state. Our breakdown of iGaming KYC requirements by jurisdiction covers what regulators expect at that step. Virginia and North Carolina, among others, also bar sportsbook advertising aimed at people under 21, which reaches affiliates through operator contracts.
What this means for operators, suppliers and affiliates
| Your role | How to use the age table |
|---|---|
| Licensed operator | Set the age by state and by product, not one global number. A Rhode Island launch needs 18 for the sportsbook and 21 for the casino tab in the same app, and Kentucky moved from 18 to 21 mid-season in July 2026. |
| Tribal casino supplier | Make age settings configurable per venue. Player tracking, kiosks and loyalty systems hard-coded to 21 lock out legal players at 18+ tribal casinos, and those set to 18 break 21+ house rules a few miles away. |
| KYC and age verification provider | Clients need a product-by-state age matrix that changes with the law. Compare vendors that handle state-level rules in our list of KYC and age verification providers. |
| Lottery retailer or iLottery platform | Watch the outliers: 21 in Arizona, Iowa, Louisiana and Mississippi, 19 in Nebraska, and 21 for video lottery terminals in some 18 lottery states. |
| Affiliate or media buyer | Default to 21+ for casino and sportsbook content. Use 18 only when you name a specific 18 jurisdiction or venue, and keep 18+ products such as DFS and prediction markets out of under-21 targeting where the state has raised the age. Our guide to how iGaming affiliate marketing works covers the compliance side of operator deals. |
What could change next
- Prediction markets: Illinois passed laws in 2026 that would bring sports event contracts under its sports wagering rules, including age restrictions. On October 2, 2026 a federal judge granted the CFTC, Kalshi and Coinbase preliminary injunctions against Illinois on preemption grounds, and Ohio’s SB 430 would require sports-contract exchanges to be state licensed. Further rulings will decide whether an 18+ product keeps competing with 21+ sportsbooks.
- New sports betting laws: any 2027 bill in Texas, Georgia, Oklahoma, Minnesota or South Carolina will set a new age. South Carolina’s 2026 bill proposed 18, while most recent laws use 21.
- Maine’s online casino launch: expected in early 2027; check the final rules for the age.
- Venue policies: tribal casinos can move from 18 to 21 at any time, so recheck any venue-level claim before you publish it.
Our monthly iGaming regulation roundup covers each change as it lands.
