Is online gambling legal in Florida? For almost every business, no. Florida allows exactly one online betting operator, the Seminole Tribe’s Hard Rock Bet, and no state licence exists for online casinos, online poker or outside sportsbooks.
Florida is the third most populous US state, so the question keeps coming back: a sweepstakes operator looking at player numbers, a PSP weighing a new merchant, or an affiliate wondering why Florida traffic converts on some offers and gets blocked on others. And in 2026 the state stopped treating sweepstakes casinos as a grey area: the Attorney General sued two of the biggest brands and the payment companies behind them.
This guide covers what is legal today, what changed in 2026, and how much exposure each type of business carries in Florida right now. For the same picture across every state, see our US gambling laws by state overview.
Is online gambling legal in Florida? What is allowed in 2026
| Product | Status in Florida (Oct 2026) | Why |
|---|---|---|
| Online sports betting | Legal, one operator only (Hard Rock Bet) | 2021 Seminole Gaming Compact, “hub-and-spoke” model |
| Slot-style “past motor racing” games | Offered by Hard Rock Bet since October 2025 | Classed by the Tribe as sports betting under the compact; not tested in court |
| Online casino (slots, table games) | Not legal | No licensing path; casino expansion needs voter approval or a new compact |
| Online poker | Not legal | No licensing path |
| Sweepstakes / social casinos | Under active state litigation | AG says they are illegal under existing law; lawsuits filed August 2026 |
| Daily fantasy sports | Grey area | No DFS statute; regulator sent cease-and-desist letters to pick’em operators in 2023 |
| Prediction markets (sports event contracts) | Operating, not state-licensed | Federally regulated by the CFTC; Florida has not taken action so far |
| Offshore sportsbooks and casinos | Illegal | Unlicensed; a licence from another state or country does not count in Florida |
Why only one company can take online bets
Everything in Florida’s online market runs through the 2021 gaming compact between the state and the Seminole Tribe of Florida. It gives the Tribe exclusive rights to sports betting statewide for 30 years, through 2051, in return for revenue-share payments the state said would total at least $2.5 billion over the first five years.

The legal trick is the “hub-and-spoke” structure. A bet placed on a phone anywhere in Florida is routed to servers on tribal land, and the compact treats the wager as placed there. That keeps it inside the Indian Gaming Regulatory Act.
Pari-mutuel operators West Flagler Associates and Bonita-Fort Myers Corp. fought this for years. They lost at the Florida Supreme Court, and on June 17, 2024 the US Supreme Court declined to hear their federal case. Hard Rock Bet had already reopened to all Florida bettors in December 2023, and West Flagler later settled with the Tribe in exchange for jai alai wagering on the Hard Rock Bet app.
What this means for you: there is no Florida sports betting licence to apply for. The realistic B2B path into Florida sports betting is supplying the Seminole operation, not competing with it.
Is DraftKings or FanDuel legal in Florida?
Not as sportsbooks. DraftKings, FanDuel, BetMGM and every other national brand are locked out by the compact’s exclusivity, and Hard Rock Bet is the only legal online sportsbook in the state. Several of those brands do reach Florida users through other products: DraftKings and FanDuel run sports event contracts under federal CFTC oversight (see prediction markets below), and DFS brands operate in peer-to-peer formats. None of that is a state gaming licence.
Which gambling apps are legal in Florida?
- Hard Rock Bet: the only state-sanctioned online sportsbook, 21+, run by the Seminole Tribe.
- Florida Lottery: state-run, 18+.
- Pari-mutuel apps: advance-deposit wagering on horse racing and jai alai with licensed operators.
- Prediction markets: CFTC-regulated, operating without a state licence and without state approval.
- DFS and sweepstakes apps: available, but contested, and in the sweepstakes case now subject to state lawsuits.
Does Hard Rock Bet offer online slots in Florida?
Not legally speaking, but it comes close. On October 28, 2025, Hard Rock Bet launched “Games powered by Past Motor Racing” in its Florida app, according to NEXT.io. The titles look like slots, with reels, themes and win animations (21 titles at launch, $1 minimum), but each outcome is set by the finishing order of drivers in past motor races rather than a random number generator.
The Tribe’s position is that this is sports wagering, because the 2021 compact’s definition of sports betting covers wagers on past or future motor vehicle races. Hard Rock Bet’s own Florida page calls it “a sports bet based on the result of past motor racing results” and still says traditional online casino gaming is not legal in Florida. The product has kept growing: Florida players can qualify through it for Hard Rock Bet’s $5 million slots tournament between October 5 and November 29, 2026.
Why this matters for operators: it is the closest thing to online casino that Florida has, and it sits entirely inside the Seminole monopoly. The legal theory has not been tested in court, so treat it as a live issue, similar to historical horse racing terminals in other states. For suppliers, the B2B opportunity is again with the Tribe, not alongside it.
Why online casinos are off the table
Two things block online casino gaming.
- The constitution. Since 2018, Article X, Section 30 of the Florida Constitution (passed by voters as Amendment 3) says casino gambling can only be expanded through a citizen-initiated vote. The legislature cannot authorise it on its own. The main carve-out is tribal compacts negotiated under federal law.
- The compact did not cover it. The 2021 compact settled sports betting. It did not authorise online slots, table games or poker for anyone.
So there are only two realistic routes to legal online casino in Florida: a statewide ballot initiative, or a renegotiated compact that gives the Seminole Tribe an online casino product. Neither is on the calendar as of October 2026. If online casino does come, the compact route means it would most likely arrive as another Seminole monopoly, not an open licensing market.
What actually happened in the 2026 legislative session
A lot of pages still describe HB 189 as if it might become law. It will not. Here is the record.
| Bill | What it aimed to do | Outcome |
|---|---|---|
| HB 189 (Trabulsy) | 100+ page rewrite: defined “Internet gambling” and “Internet sports wagering”, felony penalties, advertising ban, rules for fantasy contests, wording broad enough to catch dual-currency sweepstakes | Cleared three House committees; laid on table March 11, 2026. Not passed. |
| SB 1580 (Martin) | Illegal gaming crackdown; picked up HB 189 language in the House | Passed both chambers in different forms; died in returning messages March 13, 2026 |
| HB 591 / SB 1164 | Similar internet gambling and sweepstakes definitions | Died in committee |
| SB 168 (Truenow) | Lets local governments declare a property used as a gambling house more than twice in 12 months a public nuisance; removes the $15,000 fine cap | Passed unanimously; signed June 16, 2026 (Ch. 2026-145); effective July 1, 2026 |
The session ended on March 13, 2026. The only gambling enforcement law that made it through, SB 168, targets physical gaming rooms and slot-style machines, not online operators.
The takeaway is not that online gambling got safer. It is that Florida decided it already has the tools. The Attorney General’s office has taken the position that existing law covers sweepstakes casinos, and it acted on that five months later.
Are sweepstakes casinos legal in Florida? From grey area to courtroom
This is the biggest 2026 change, and many player-facing guides still list sweepstakes casinos as “legal” in Florida. That label is now out of date. For how other states treat the model, see our sweepstakes casino legal map.

On August 19, 2026, Attorney General James Uthmeier filed two lawsuits in Hillsborough County Circuit Court. The defendants, as reported by NEXT.io and CasinoBeats:
- VGW (Chumba Casino, LuckyLand, Global Poker), with payment-side defendants Yodlee, Trustly and Worldpay
- Stake (Stake.us operator Sweepsteaks Ltd, plus Easygo, Medium Rare, Kick Streaming and co-founders Bijan Tehrani and Ed Craven), with payment-side defendants Praxis and Breeze Labs Payments
The complaints argue that the dual-currency model, where players buy Gold Coins bundled with redeemable Sweeps Coins or Stake Cash, is real-money gambling dressed up as a promotion. They allege violations of Florida’s gambling laws and the Florida Deceptive and Unfair Trade Practices Act (FDUTPA). The state wants an injunction, recovery of the money Florida players lost, disgorgement, restitution and civil penalties of up to $10,000 per wilful violation, rising to $15,000 where the victim is over 60 or disabled.
Then on September 25, 2026, the AG sent letters to Google, Meta, Reddit, Snap and TikTok demanding they stop running sweepstakes casino ads to Florida residents and explain in writing how they will do it, with an October 23, 2026 deadline. The letters state that promoting illegal gambling in Florida “is similarly unlawful under Florida law.”
Notice the pattern. Florida is not just going after operators. It is going after the payment rails and the ad platforms. That is the part most coverage misses, and it matters if your business sits anywhere in that chain.
Is fantasy sports legal in Florida?
Florida has no statute that explicitly authorises paid fantasy contests. On September 25, 2023, the Florida Gaming Control Commission sent cease-and-desist letters to PrizePicks, Underdog and Betr over pick’em games, and several operators pulled those products from Florida on March 1, 2024. Most returned with peer-to-peer formats instead of house-banked pick’em. The regulator’s own FAQ still says fantasy sports wagering outside the Seminole channel is “most likely illegal.”
The status is unresolved. HB 189 would have written fantasy rules into law, and it died. If you run or supply a DFS product, treat Florida as tolerated but contested, and expect format to be central to any future dispute.
Is Kalshi legal in Florida? Prediction markets in 2026
Kalshi, Polymarket US, and in-house products from DraftKings, FanDuel, Fanatics, Underdog and Robinhood offer sports event contracts in Florida under CFTC oversight, without a state gaming licence. Kalshi accounts are open from age 18. Florida has so far not challenged these products, unlike several states that have sent cease-and-desist letters or sued.
Two things could change that. First, Florida sits in the Eleventh Circuit, so pro-Kalshi rulings from other federal circuits do not bind it. Second, the Seminole compact’s exclusivity on sports betting gives the state and the Tribe a strong reason to push back if event contracts start eating into Hard Rock Bet. Prediction market firms have also been major donors in the 2026 governor’s race, according to reporting by Gambling Insider, which tells you how much they think the next administration’s stance matters. Our prediction markets explainer covers how event contracts work and the federal preemption fight.
Can you use offshore betting sites like BetOnline in Florida?
Not legally. The Florida Gaming Control Commission’s FAQ is blunt: unless a wager goes through the Seminole Tribe’s sportsbook, it is most likely illegal, and a licence from another state or country does not matter if the site accepts Florida residents. The regulator warns that bettors can face charges for using an illegal bookmaker or an unlicensed offshore site.
For offshore operators there is no compliant path, and for PSPs and affiliates working with them the 2026 lawsuits show Florida is willing to name the businesses around the operator.
How old do you have to be to gamble in Florida?
Florida does not use a single gambling age. The threshold depends on the product and, for the Seminole channels, on the compact. The legal gambling age by state table shows how this compares nationally.
| Activity | Minimum age | Notes |
|---|---|---|
| Florida Lottery | 18 | State-run |
| Pari-mutuel wagering and cardroom poker | 18 | Licensed racetracks, jai alai and cardrooms |
| Seminole casino slots and table games | 21 | Tribal venues under the 2021 compact |
| Hard Rock Bet online sports betting and games | 21 | Must be physically in Florida |
| Daily fantasy sports | 18 | Operator policy; no Florida DFS statute |
| Prediction markets (Kalshi) | 18 | Federal, not state, rules |
| Sweepstakes casinos | Set by operator | Now under state litigation |
For operators and compliance teams, the practical consequence is that KYC flows in Florida must handle two thresholds, 18 and 21, in one state.
Who carries the risk: a Florida exposure map by business role
Most Florida guides are written for players. If you are on the business side, the useful question is different: if Florida acts, does it act against you? Here is how the 2026 picture looks by role, based on the enforcement actions above.
| Your role | Exposure in Florida | What 2026 shows | Practical move |
|---|---|---|---|
| Licensed US operator (sportsbook or iCasino) | No legal entry | Compact exclusivity upheld through 2051 | Geofence Florida; watch compact talks, not the legislature |
| Sweepstakes / social casino operator | High | AG lawsuits seek injunction, recovery of player losses and FDUTPA penalties | Get Florida-specific counsel; decide on geoblocking before a C&D or suit, not after |
| Payment processor, PSP, open-banking provider | High and rising | Worldpay, Trustly, Yodlee, Praxis and Breeze Labs named as defendants | Review MCC coding and merchant onboarding for dual-currency merchants with Florida players |
| Ad platforms, affiliates, streamers, media buyers | Medium and rising | AG demanded major platforms stop sweepstakes ads in Florida by Oct 23, 2026; Kick Streaming named in the Stake suit | Exclude Florida from sweepstakes campaigns; expect platform policies to tighten |
| Offshore real-money operator | High | Regulator says out-of-state licences do not count; no licence possible | No compliant path |
| DFS operator | Medium | Earlier C&D letters; no statute either way | Peer-to-peer formats, legal opinion, monitor 2027 session |
| Prediction market / FCM | Low today, uncertain | No Florida action; federal preemption still being litigated | Track the Eleventh Circuit and the new governor’s position |
| B2B supplier to the Seminole operation | Low | The one fully legal online channel, now including slot-style racing games | Standard tribal and vendor licensing route |
| Land-based amusement or “skill” machine operators and landlords | High | SB 168 nuisance law in force; the AG reported 3,100+ machines seized, $1.7 million in cash and 81 arrests in 2026 raids by June | Audit tenants and devices; fines are now uncapped |
The pattern is clear: Florida is widening its net from the operator to everyone who helps the operator get paid or get found. If you are a PSP or an affiliate, the old assumption that only the casino takes the risk no longer holds here.
Can players be charged for online gambling in Florida?
Yes, in principle. Under section 849.08 of the Florida Statutes, playing any game of chance for money or something of value is a second-degree misdemeanor. Prosecution of individual online players is rare, but the law is on the books. It matters to operators because the AG’s lawsuits ask courts to return player losses, which turns player harm into the state’s main argument against the businesses involved.
What to watch next
- October 23, 2026: deadline for Google, Meta, Reddit, Snap and TikTok to respond to the AG’s ad demand.
- November 2026 election: Florida elects a new governor. The next administration controls compact negotiations and the state’s posture on prediction markets.
- Stake and VGW litigation: any early injunction ruling in Hillsborough County will tell the rest of the sweepstakes market whether to leave Florida.
- Hard Rock Bet’s racing games: any challenge to the “past motor racing” theory would test how far the compact’s sports betting definition stretches.
- 2027 legislative session: expect HB 189-style internet gambling definitions to come back, likely with the sweepstakes and advertising language intact.
- Compact talks: the only realistic route to legal online casino, and probably a Seminole-only one.
What this means for you
If you are planning a Florida entry, there is nothing to apply for. Florida is a single-operator market with no licensed online casino, and in 2026 it made clear that it considers sweepstakes casinos to be online casinos. The real decisions for most B2B teams are defensive: whether to geoblock, whether to keep processing for certain merchants, and whether Florida traffic belongs in your campaigns at all.
If you need help with those calls, start with specialists who work on US state law. You can compare iGaming law firms and licensing consultants, review KYC and compliance providers for geolocation and age checks, or check how payment providers handle restricted states.
